Driving Instructor, Guilty of Sexual Charges, to be Sentenced in December

HUNTINGTON, Ind. (Indiana’s NewsCenter) - A former driving instructor learned Monday morning that he'll be sentenced in December for sexual battery and sexual misconduct with a minor.

In September, a Huntington jury convicted 48-year-old Gary Town on one count of sexual battery and one count of sexual misconduct with a minor. The panel deadlocked on a second count of sexual battery.

Town was charged after two male driving students accused him of making several inappropriate sexual comments and physical advancements toward them.

The former driving instructor was scheduled for sentencing today, October 31st, but Town's defense attorney, Robert Gevers, says the Huntington County Probation department did not submit their presentence investigation report in time.

The report, says Gevers, details Town's education, family history, ties to the Huntington community, etc. "It took them some while to complete that, and so we got that just shortly before - just one day before - the last sentencing date," says Gevers. "So, the judge gave us more time to review that and respond and present witnesses for Mr. Town on his behalf."

Town, a once highly respected and involved member of the Huntington community, is expected to have several people testify on his behalf. "We're still going over those details. Mr. Town has provided a list of family and community members, friends and colleagues from over the years. We anticipate that at least several of them will testify at the sentencing hearing."

Town will be sentenced in Huntington at 9:00 a.m. in Huntington County. He also faces two similar charges in Grant County and will stand trial there in February.
