KOSCIUSKO COUNTY, Ind. (Indiana's NewsCenter) - A judge ruled against lawyers for the youngest defendant in a murder plot.
The judge decided that the things 12-year-old Paul Gingerich said "are" admissible.
Gingerich's attorneys claimed police didn't properly tell the boy he had the right to remain silent when he and two other boys were caught in Illinois.
Prosecutors say Gingerich helped fatally shoot the step-father of one of his friends.
He's scheduled to stand trial in February.
The two other boys pleaded guilty and were sentenced for their roles in the death of 49-year-old Phillip Danner.
