Pattison Files For Mistrial

WABASH COUNTY, Ind. (Indiana's NewsCenter) – Not more than a month after being convicted of murder by a jury, Scott Pattison filed paperwork Wednesday for a mistrial and to set aside the jury verdict.

Pattison and his lawyer site that after the verdict, one of the jurors was interviewed and reported that the jury performed an experiment on the weight machine during their deliberation. By performing their own experiment it’s believed that the jury improperly infected the deliberation process with evidence not presented during the trial.

Additionally by allowing the jury to conduct its own experiment in the courtroom was a violation of the Defendant’s right to be present for the review of evidence not initially sent to the jury.

The weight machine was the instrument believed to be used in the murder of Pattison’s wife Lisa.

This experiment performed by the jury was cited by the interviewed juror as the reason three jury members changed their votes from not guilty to guilty.

Scott Pattison is set to be sentenced for the murder of Lisa Pattison Friday, December 3rd.
