Racy MySpace Pictures Spark Lawsuit With Local School

CHURUBUSCO, Ind. (Indiana’s NewsCenter) - Two local teens are suing their school district and principal after they were punished for posting racy pictures of themselves on MySpace.

The American Civil Liberties Union filed suit, on the girl's behalf, against the Smith-Green Community School Corporation in Churubusco and Churubusco High School Principal Austin Couch.

The suit comes from a summer sleepover where two unidentified sophomore girls took suggestive pictures of themselves and posted them on their MySpace page.

Someone then printed the pictures, which do not associate the girls with the school, and gave them to Principal Couch when school was back in session.

Consequently he suspended both girls from school sports for one year.

ACLU officials say school administrators violated the girls' first amendment rights.

Travis J. Grams is a former Churubusco High School student who agrees with ACLU officials. He says this isn’t the first time an incident like this has happened at Churubusco High School.

“It’s had a long history of these kind of punishments,” said Grams. “They like to go overboard, so I’m not surprised.”

Churubusco mother of two Amiee Osborne says the punishment was too harsh.

“I don't think that it should have been so severe but yes I do think they should have taken notice of it and done something,” said Osborne.

In a statement, school Superintendent Steve Darnell says, "we expect our athletes to be held to a higher standard of behavior identified by the IHSAA and our board through adopted student behavior rules and expectations... when students choose to violate extra-curricular expectations, there are consequences."

The girls' suspension was reduced to sitting out a quarter of the season of their team sport.

They did have to complete counseling and make a public apology to the school athletic board in order to receive the reduced punishment.
