Federal Judge Dismisses RTW Challenge

FORT WAYNE, Ind. (www.incnow.tv) - A federal case against Indiana's Right To Work law was thrown out by a judge Thursday.

Chief Judge Philip Simon of the U.S. District Court of Northern Indiana granted a defense motion to dismiss Sweeney v. Daniel, which challenged the constitutionallity of the law signed by former Gov. Mitch Daniels, R-Ind., in February.

"We appreciate the court's thorough analysis," Attorney Gen. Greg Zoeller, R-Ind., said in a statement. "The federal court's decision supports the legal authority and policy decisions of the people's elected representatives in the Legislature."

Indiana is one of 24 Right To Work states, which prohibits unions from requiring non-union members to pay fees in exchange for membership representation.
