FORT WAYNE, Ind. (Indiana's NewsCenter) -A citizen complaint is filed against the Fort Wayne Police Department in a deadly standoff.

28 year-old Rudy Escobedo was killed by police during a standoff three years ago.

Escobedo's family tells Indiana's NewsCenter that a federal summary judgement shows there is sufficient evidence to warrant a trial against the police department.

The family filed a citizen complaint, citing two accounts of excessive force and two accounts of supervisor liability.

The family alleges the Fort Wayne Police Department withheld this information and the family can now prove it with phone records.

Calls into the Fort Wayne Police Department have not been returned.
