Lawsuit Over Gun Accusation Heads to Court

INDIANAPOLIS (AP) - The Indiana Court of Appeals says two men who were falsely accused of pulling a gun on a pizza delivery driver can sue the driver and his employer.

The court overturned a Hamilton County judge's ruling and ordered a trial.

Thomas Williams and Sanford Kelsey were handcuffed and detained
for an hour and a half while officers investigated the accusation.

According to court documents, the two men had bought a pizza in Westfield and had left when a delivery driver reported to police that one of the men had pulled out a gun and gave an officer the license number of the men's car.

Police later determined that the pizza delivery man couldn't have seen what he claimed.
