American Legion in Noble County Files Lawsuit Against Smoking Ban

Noble County, Ind. (Indiana's NewsCenter) - Indiana's smoking ban will take effect next Sunday July 1st.

An America Legion post in Noble County is taking legal action to stop it.

American Legion Post 243 has filed a federal lawsuit saying the ban is too vague. The post is also saying the ban violates equal protection clauses of the U.S. and Indiana constitutions and violates a freedom of conscience measure in Indiana's constitution.

The statewide smoking ban excludes bars, casinos, tobacco stores and private clubs.
