FORT WAYNE, Ind. (Indiana's NewsCenter) - A controversial "I Heart Boobies" bracelet is at the center of a recently filed federal lawsuit against Fort Wayne Schools Superintendent Wendy Robinson.
The lawsuit was filed on Friday by the American Civil Liberties Union (ACLU) on behalf of an FWCS sophomore and her mother.
Court documents assert that the girl purchased the bracelet with her mother in December 2011. The girl reportedly wore the bracelet for months in support of breast cancer awareness and her mother, a breast cancer survivor.
The suit also states that in March an assistant principal in the district told the student she couldn't wear it and took the bracelet away. Even though the "I Heart Boobies" bracelet was later returned, the girl and her mother argue this violated her First Amendment right to free speech.
The bracelets also display the web address for "Keep A Breast Foundation," a not-for-profit. Each bracelet sells for about $3.99, with proceeds going towards the fight against breast cancer.
The suit asks that the student be allowed to wear the bracelet to school without fear of punishment. It also asks for court costs and "all other proper relief."
FWCS officials had no comment on the lawsuit.
