Indianapolis (Indiana’s NewsCenter) - The Indy police officer who's blood test was thrown out of court after he caused a reported drunk driving crash that killed a motorcyclist in August of 2010 is being recalled as evidence.
The Indiana Court of Appeals reversed the trial court's decision allowing the blood-draw as evidence.
Indy Metro Police Officer, David Bisard, faces charges in the death of Eric Wells.
Bisard's attorney had argued that the medical assistant who drew the blood didn't follow protocol.
