Prosecutor Rules Officer was Justified in Shooting Hayden

Allen County, Ind. (Indiana’s NewsCenter) - The Allen County prosecutor will "not" file charges against A Fort Wayne police officer who shot and killed a man who'd shot a U.S. Marshal.

26-year-old Marcus Hayden was shot by Officer Derrick Demorest April 9th after he dropped out of a window at the Eden Green Apartments.

The Journal Gazette reports that the U.S. Marshals and agents from the ATF were trying to arrest Hayden for violating his probation for a drug crime, when he started shooting at them, hitting one in the leg.

As Hayden ran, Officer Demorest fired when Hayden refused to stop.

Hayden later died at the hospital.

The prosecutor ruled Officer Demorest used justifiable force in the shooting.
