School District Challenges State On Educational Funding

NOBLESVILLE, Ind. (Indiana's NewsCenter) - The state is asking a judge to throw out a constitutional challenge on the way Indiana distributes education funding.

During a hearing on Wednesday the Indiana Solicitor General Tom Fisher told Hamilton Superior Court Judge Steve Nation that schools are state entities and lack legal standing to sue the state.

The complaint comes from Hamilton Southeastern Schools, Franklin Township Schools and Middlebury Community Schools. They claim the school funding formula unfairly penalizes growing districts.

They contest that the formula violates the state constitution's requirement for "general and uniform" funding of public education.

A ruling isn't expected before next month.
