INDIANAPOLIS, Ind. (Indiana's NewsCenter) -- A grand jury has indicted the former Chairman of the Indiana Utility Regulatory Commission.
David Lott Hardy, who headed the IURC until Governor Mitch Daniels fired him last year, faces three felony counts of official misconduct.
Prosecutors claim that Hardy helped Scott Storms land a job with Duke Energy while storms participated in proceedings involving the utility.
Prosecutors say Hardy also failed to disclose communication he had in 2008 and 2010 with a Duke employee regarding cost estimates for a 3 billion-dollar Duke Energy plant in Southwestern Indiana.
Terry Curry, the Marion County Prosecutor says, “The project has an enormous impact upon Duke Energy, upon Duke Energy's ratepayers and the state of Indiana, and I think you have to put what occurred in the context of the magnitude of that project.”
If convicted on all three counts, Hardy could be sentenced to up to nine years in prison and fined $30,000.
