FORT WAYNE, Ind. (Indiana’s NewsCenter) -- Investigators have not yet said whether Aliahna was sexually assaulted before being killed and Plumadore does not have a prior record of child molestation.
However, some people question why 14 registered sex offenders live in the Northway Mobile Home Park steps away from children.
Local detectives say by no means is Indiana a safe haven for offenders.
Offenders who come to Indiana must stay on the registry for the longest time period possible.
So, if Michigan requires 15 years and Indiana requires 10, the offender must be on the registry for 15 years. The "whichever is longer" language ensures that Indiana is not a dumping ground for other states' offenders looking to shave time off their registration.
But there are also three categories of offenders in Indiana with different restrictions.
Cpl. Mike Smothermon, and Allen County Sheriff's Dept. Detective says, "The sexually violent predatory has the most restrictive statutory rules, and then the offender against children, and then the sex offender.
Classification depends on the conviction's details.
Out of state offenders are classified based on the Indiana law that most accurately matches their offense.
Allen County obtains conviction documents pertaining to every conviction for which an offender is required to register and then researchs and identifies specific details so proper classification can be made according to Indiana law. They do this with out of state offenders also but they have to establish which Indiana sex offense the out of state conviction is substantially equivalent to because not every state uses the same terminology.
The county then applies Indiana registration requirements and know if they will be required to abide by the 1,000 foot rule and whether they will be required to register annually or quarterly.
