MERCER COUNTY Ohio (www.incnow.tv) ---A law enforcement review of a police action shooting in Celina Ohio produces a vote of confidence for the city police officer that shot and killed an armed man.
The officer is not officially in the clear.
The Mercer County Prosecutor has to make the call on whether it was a warranted shooting.
But the sheriff in that county is saying it appears to be a case of justifiable homicide.
39-year old Robert Hensley was shot in the left arm and through his torso on April 10th by officer Andy Regedanz outside Lake Shore Auto Sales.
Regedanz was called to the scene because someone reported Hensley was walking down a city street shirtless, wearing a cowboy hat, and twirling a gun.
Sheriff Jeff Grey told reporters Friday, four people witnessed Regedanz approach Hensley and demand that he stop and show his hands.
The investigation revealed Hensley, who was facing away from the officer, piped up that he was "packing", then drew a revolver and turned toward Regedanz, before the officer fired the fatal shots.
It turns out Hensley's gun wasn't loaded.
" It took the sheriff's office nine days to investigate it. Officer Regedanz had a split second to make a decision, and he didn't have the benefit of knowing everything that we took nine days to learn," Sheriff Grey said.
The sheriff is set to turn over findings to the prosecutor’s office.
The sheriff says he will recommend a grand jury review the facts and evidence, since there was a loss of life.
Robert Hensley’s family told police he had recently been exhibiting unusual behavior, including hearing "voices".
Regarding officer Regedanz, Sheriff Grey declined to comment on information that Regedanz had been suspended from active duty for a period of time earlier this year
Reports indicate his behavior had been out of the ordinary, and that he was ordered to undergo a psychological evaluation.
The mayor of Celina was out of town Friday, and the city safety director did not return a message seeking an explanation.
Regedanz is a 12-year veteran of the city police force.
